Writer Beware: Penguin And Author Solutions

David Gaughran throws down the gauntlet in his excellent blog post The Author Exploitation Business. He writes:
[Being a writer is] a dream job, and like any profession with a horde of neophytes seeking to break in, there are plenty of sharks waiting to chew them to bits.

... [M]any organizations who claim to help writers, to respect them, to assist them along the path to publication are actually screwing them over.

Before the digital revolution made self-publishing viable on a wide scale, the dividing lines were easier to spot. Traditional publishers paid you if they wanted to buy the rights to your novel. Self-publishers were people who filled their garages with books and tried to hawk them at events. And vanity presses were the scammers, luring the unsuspecting with false promises and roundly condemned by self-publishers and traditional publishers alike.

Today it’s very different. The scammy vanity presses are owned by traditional publishers who are marketing them as the “easy” way to self-publish – when it’s nothing more than a horrifically expensive and terribly ineffective way to publish your work, guaranteed to kill your book’s chance of success stone dead, while emptying your bank account in the process.
The target for David's ire is Penguin, owners of the biggest shark out there: Author Solutions. His article is a must read for any writer.

Writers Beware Of Autharium


It seems like this is the time of year for scams targeting writers. Passive Guy, aka David Vandagriff, recently wrote a blog post warning writers against Autharium, "a new British site that makes it easy for indie authors to publish and distribute their work".

Passive Guy writes:
By distributing your book through Authariam, you are giving Authariam exclusive world-wide ebook rights to your book for the full term of the author’s copyright, which PG is informed is the author’s life plus 70 years under British copyright law. British law governs this contract.

You can remove your book from Authariam, but Authariam still owns world-wide rights.
Yikes!


The Digital Reader: Authariam Grabs ALL Rights Including Audiobook, Movies, ANY Digital Content


The Digital Reader picked up on the story soon after Passive Guy blogged about it and warned that, the way their contract was written,
Not only does Autharium demand an exclusive, their definition of digital form is so broad that it arguably includes subsidiary rights like audiobook, movies, and really any digital content.
 Also,
Autharium can legally sell the audiobook rights out from under the author, and the same goes for the movie rights. Hell, that site could sell the movie rights to their entire catalog for 10 pounds and a job offer, and it would be completely legal.
Run away from this company!

Beware Alibi Publishing, John Scalzi Warns: "This is the worst book contract I have ever encountered"


In John Scalzi's latest blog post, A Contract From Alibi, he writes that Alibi's contract terms are so heinous he wouldn't recommend them to his worst enemy.

At least, do not sign the their standard, boilerplate contract. Scalzi writes:
I want to be clear: I can say, without reservation, that this is the worst book contract I have ever personally encountered. Not only would I never sign it — which should be obvious at this point — I can’t imagine why anyone whose forebrain has not been staved in by an errant bowling ball would ever sign it. Indeed, if my worst enemy in the world was presented with it and had a pen poised to scratch his signature on it, I would smack the pen out of his hand and say to him, “I hate you, but I don’t hate you this much.”
Alibi is a digital imprint of the Random House Publishing Group.

In his article John Scalzi steps through some of the more egregious sections of the contract and, colorfully and with wit, tells authors why they should run, not walk, away from this company.

John Scalzi is best known for writing science fiction, for which "he won the John W. Campbell Award (2006) and has been nominated for the Hugo Award for best novel (2006, 2008, 2009). (Amazon Author's Page)"

If you're thinking about submitting work to any of the new digital imprints (Loveswept, Alibi, Hydra, Flirt) A Contract From Alibi is a must read. Heck, even if you're not thinking about submitting to them, it's good to know what to look out for in the industry.

Scammers are sending out fake invitations to speak at Bexley College. So far mostly SF/F writers have been targeted.

When I first read this email I was puzzled: the scammers don't ask for money so how are they benefiting? Victoria Strauss writes:
The mark is told s/he must pay a "Government (United Kingdom) Main Application Fee for a UK work permit" of several hundred pounds. Once that money is sent, the scammers ask for more:

The Albee Agency Fakes An Endorsement By Chuck Wendig


In their "Testimonial" section, The Albee Agency had this endorsement apparently from Chuck Wendig of terribleminds:
I loved the personal service of The Albee Agency. Knowing I could call my publicist whenever I needed anything was a huge relief. They are all consummate professionals - from their online media roadmap to the television and radio interviews they arranged - I am very impressed and will be back.
Pretty great endorsement, right? Wrong!

Chuck Wendig never wrote it. Any of it. The endorsement is completely fake.

Here's what Chuck Wendig did say about The Albee Agency:
It sounds like a really horrible Dan Brown knockoff.

It ain’t.

It’s some kind of book publicity site — er, scam.

Because I didn’t give that testimonial.

Nor did, as I understand it, any of the authors there.

My testimonial would’ve included more profanity. And a video of me seductively stroking my beard.

So, just a head’s up.

Other Fake Testimonials: Myke Cole & Maureen Johnson


It doesn't stop with Chuck Wendig, The Albee Agency also put up fake endorsements from authors Myke Cole and Maureen Johnson.

It seems that most of the testimonials we know to be fake have been taken down from The Albee Agency's website, but not before Victoria Strauss over at Writer Beware Blogs took screenshots of them. Simon & Schuster Partners With Author House To Create Archway Publishing


Simon & Schuster Creates A Self-Publishing Portal


Just today Simon & Schuster announced it's partnering with Author Solutions to create Archway Publishing.
[Archway Publishing] will focus on self-published fiction, nonfiction, business and children's books. Digital technology has helped lead to the proliferation of self-published books, with Sylvia Day and Amanda Hocking among those becoming bestselling authors.
Archway will offer a range of services to budding authors beginning at $1,599.
Archway will offer a range of services, from a basic $1,599 package that includes "editorial assessment" and "cover copy review" to a $24,999 "Outreach" program for business books that features an "author profile video" and a reception at BookExpo America, the industry's annual national convention.

Why this is NOT good news for authors


I wrote about 1,000 words on this subject and then came across Carla King's article on Penguin's purchase of Author Solutions earlier this year: Why Self-Publishers Should Care That Penguin Bought Author Solutions. Yes, the article is about Penguin rather than Simon & Schuster but the same objections apply. Carla writes:
Smashwords founder Mark Coker is a longtime critic of Author Solutions, pointing out in his blog that they make more money from selling services to authors than selling authors' books: "Author Solutions is one of the companies that put the 'V' in vanity.  Author Solutions earns two-thirds or more of their income selling services and books to authors, not selling authors' books to readers ..."
Add to that Jane Friedman's comments:
Jane Friedman, in her Writer Unboxed blog, notes that ASI's acquisitions are "appearing more and more like a huge scramble to squeeze a few more profitable dollars out of a service that is no longer needed, that is incredibly overpriced when compared to the new and growing competition, and has less to recommend it with each passing day ..."
In my view this isn't a win for self-publishers, this is just another shark in already crowded waters.

Writer beware.

Writer Beware: The Return Of The Vanity Press

I was first introduced to the idea of the vanity press by Umberto Eco in his book Foucault's Pendulum. Eco does an excellent job of explaining why vanity presses have such a bad name: they are the literary equivalent of carnies and writers are their marks.

Years ago, before I had discovered Joe Konrath's blog, I confused vanity publishing with self publishing. Vanity publishing strips the author of their money and gives next to nothing back while self-publishing--publishing ones book oneself--is a sound business strategy.

I used to think vanity publishing was dead, driven out by a tsumami wave of embowered writers publishing their own work themselves.

I was naive.

For the past week or so I haven't paid much attention to the ads on my site. I apologize. Over the past two days I've noticed many of these ads were for businesses offering to help writers publish their books.

At first I didn't think much of it. It can make good sense for a busy person to pay someone to help with certain aspects of publication--help with cover design, line editing, content editing, formatting, and so on. These services can sometimes cost as much as $1,000 dollars. (I'm not including the cost of a book trailer, website, and so on.)

What I've just mentioned is still self-publishing because, and this is the key point, the writer themselves uploads the finished file to the stores where it will be sold (e.g., Amazon, Barnes & Noble, Kobo, Smashwords, and so on). If a book is self-published it means the writer published it rather than paying someone else to, as in traditional publishing. Yes, in traditional publishing the money flows to the writer. The publishing company shares the proceeds from each sale with you, the writer, because they are the ones who shelled out the money to publish your book. They've earned it.

At the very least, even if you get someone to help you upload the file to, for instance, Amazon, it is very important that you are the one who controls the accounts. This gives you access to your sales figures. You'll know exactly how many books you sold at each place (Amazon, Barnes & Noble, Smashwords, etc.), you'll set how much each book will be sold for and the retail outlet will give you detailed royalty statements. No guessing involved.

Now, someone might say, "But, Karen, I just don't want the bother! I'll gladly pay someone to do that sort of thing for me. I just want to hand my finished manuscript to someone, have them take care of the formatting, the cover design, the uploading. I don't want to have to bother with all those different accounts--one with Amazon, one with Smashwords, one with Barnes & Noble, one with Kobo; my head is hurting already!--I just want someone to take my manuscript, do it up, publish it and then send me a check every so often."

Okay. Fine. But that isn't self-publishing. You have two options: go the vanity press route, which I do not recommend, or shop your manuscript to traditional publishers.

If self-publishing isn't for you--and there's nothing wrong if it isn't--then by all means don't do it! There are many reputable publishers out there and sometimes small presses will accept projects that larger ones won't. But please don't waste your hard-earned money by going the vanity press route.

How to recognize a vanity press: The company charges you to format your book and then also takes a percentage of each sale.

One vanity press I contacted was offering, for the 'mere' sum of $5,000, to set the writer up with a website--how generous! When I asked if that included a blog they said no, a blog would be $350 extra. Uh huh.

Sorry for nattering on about this. I'm steamed. It bothers me when folks try and prey on writers. I'm not against writers paying others for help--cover art, formatting, editing, and so on--but for a company to charge outrageous sums for these services and then to also want 50% of all sales ... Wow. That's chutzpah.

Penquin's Purchase Of Author Solutions: Going To The Dark Side?

When I was a child, I dreamt of becoming an author and being published by Penguin. (Yes, I was an odd child, but that's a post for another day!) Even after I was stripped of my illusions about the publishing industry the name "Penguin" stood out for me as the mark of something special.

No longer.

If you haven't read David Gaughran's article on Penguin's purchase of Author Solutions you should. It gives all the facts and in David's succinct and eminently readable style. Here's an excerpt:
Penguin’s parent company, Pearson, has announced the purchase of Author Solutions for $116m – news which has shocked writers, especially given Author Solutions’ long history of providing questionable services at staggering prices.

Author Solutions are the dominant player in the self-publishing services market – via their subsidiaries Author House, Xlibris, Trafford, and iUniverse – and had been looking for a buyer for several months. According to the press release, Author Solutions will be folded into Penguin, but will continue to operate as a separate company. Penguin’s CEO John Makinson stated:

“This acquisition will allow Penguin to participate fully in perhaps the fastest-growing area of the publishing economy and gain skills in customer acquisition and data analytics that will be vital to our future.”

What does Author Solutions bring to the table? Well, for starters, around $100m in annual revenue. Roughly two-thirds of that money comes from the sale of services to writers, and only one-third from the royalties generated by the sale of their books.

Pause for a moment and consider that statistic. Penguin isn’t purchasing a company which provides real value to writers. They are purchasing an operation skilled at milking writers.

This is not a new accusation against Author Solutions. Industry watchdogs such as Writer Beware have received a litany of complaints about Author Solutions and their subsidiaries over the last few years: misleading marketing, hard-selling of over-priced services, questionable value of products provided, awful customer service, and, after all that, problems with writers being paid. David gives examples a-plenty to back up his claims. Author Solutions is well known on sites like Writer Beware and Predators and Editors. The news that Penguin purchased the company astonishes me. I can only hope that Penguin discontinues Author Solutions' bad business practices and works with authors instead of preying on them.

Publish America: Writer Beware


PublishAmerica has been in the news lately and I wanted to write a post detailing why a writer should, in my opinion, never ever get involved with this company but David Gaughran beat me to it. He writes:
For those unaware of the checkered history of PublishAmerica, a quick summary:

1. They are one of only two organizations to earn the dubious honor of having their own sub-forum on Absolute Write’s Bewares & Background Checks (the other being Robert Fletcher’s infamous web of companies).

2. Preditors and Editors have a lengthy entry warning writers away.

3. The Better Business Bureau rates PublishAmerica as an “F”.

4. The leading industry watchdog – Writer Beware – regularly cover PublishAmerica’s various attempts to squeeze money out of their writers (e.g. here, here, here, here, here, and here - and that’s just the tip of the iceberg).

5. PublishAmerica are now the subject of a class-action suit, the allegations being very familiar to anyone who has followed the company (full complaint can be read here).

In short, PublishAmerica is probably the last place I would recommend to a writer.

Wherever you send your manuscript, I wish you the best of luck. Check your prospective publisher out with organizations such as Writer Beware and Preditors and Editors, do a search on their name and ask other writers what they have heard about the company before you sign anything.

Writer Beware: Outskirts Press

Writer Lee Goldberg (Monk, The Dead Man series) spoke up a few days ago about a scam that Outskirts Press is running.

Here is a snippet from the press release put out by Outskirts Press:
These services solve a real problem for many authors who dream of making it big in Hollywood. In fact, just getting Hollywood's attention is nearly impossible, but with the Book Your Trip to Hollywood suite of services from Outskirts Press, authors receive turn-key, full-service assistance with the push of a button. And with each option, authors receive the feedback and/or participation of a real Hollywood producer and production company; the final results are added to a Hollywood database that is perused by industry professionals for new projects; and exclusive efforts to option the author's book are immediately set into motion. The author doesn't have to lift a finger.
As Lee writes, "Except to pull out his or her credit card."

If a writer falls for Outskirts Press' song and dance, how much could he get taken for? The following is from Writer Beware writer Victoria Strauss:
[T]he total bill for your Hollywood pipe dream comes to $15,239. Outskirts can even claim that this is a bargain: the very similar services offered by Author Solutions will set you back over $18,000. 
 At the end of his article Lee Goldberg advises, "Give your $15,000 to the first homeless person you see instead... not only would it be a better use of your money, you would also have exactly the same chance of making a movie sale as you would giving it to Outskirts". That seems like a fair assessment.

Authors File Class Action Lawsuit Against PublishAmerica


Finally! PublishAmerica has been scamming authors out of their hard earned dollars for too many years. If you haven't heard about the shenanigans of PublishAmerica, take a gander at what Writer Beware has to say.

The Great PublishAmerica Hoax:
Writer Beware has received scores of complaints over the years about PublishAmerica, and hundreds more can be found online. The company has been the subject of at least one successful arbitration proceeding, resulting in a substantial award for a PA author.

On June 11, 2012, a class action complaint against PublishAmerica was filed in US District Court in Maryland, in the name of three plaintiffs. See Writer Beware’s blog for more.

This information is current as of the update date at the top of the page. Writer Beware receives complaints, advisories, reports, and/or questions about PublishAmerica at least monthly.
My advice: Don't even think about sending your work to PublishingAmerica. Few things in life are guaranteed, but if you send your work to PublishAmerica you're sending it into painful obscurity.

Here's part of the introduction to the complaint in the class action lawsuit:
Like plaintiffs, thousands of other aspiring authors who signed up with PublishAmerica have become demoralized because the publishing contract appears to be little more than a pretext for selling dubious services...These authors also feel trapped because PublishAmerica owns the rights to their books for seven to ten years. This presents a Hobson's choice for the authors: either throw good money after bad for suspect promotional services or abandon the book that was a labor of love.

Writer Beware: Undead Press & Editing Clauses

Hi, I just received this comment:
"Hey, it seems that actually refers to something about our domain name from 2012.. Way before we bought this domain name, that is not related to us in any way. We bought the domain a few months back. Somehow this ended up as a comment about our site on Facebook now."

I don't want to remove this post because I think history is important. However, (and I haven't researched the claim being made) I see no reason not to believe that the domain name has been sold. Please do keep this in mind when deciding whether to submit your work to Undead Press. And, please, ALWAYS read the terms of service of any publishing company before you submit your work to them.  Here is a link to the Terms and Conditions of Undead Press.

Here is the original post: 

Imagine getting your work accepted for publication, waiting on pins and needles for your copy of the work to arrive, ripping open the package, and finding it had been substantially altered without your permission. Mandy DeGeit sent her short story to Undead Press, it was accepted, but on publication not only was her title misspelled but her story had been substantially altered. She writes:
Let’s see: They turned a non-gendered character into a boy, they named the best friend, they created a memory for the main character about animal abuse. They added a suggestion of rape at the end… I feel like they ruined the suspense in the story.

After bringing this to the publisher's attention (Anthony Giangregorio) this is what he had to say:
wow, i truly cant believe that e,mail. you go girl. this one one hell of a story about dealing with unstable writers
lets see.
on the contract, it clearly says publisher has the right to EDIT work. you signed it. are you saying you are a dishonest and immoral person and will now try to deny you signed the contract? well i have a copy right here and as for the story. the editor had a hard time with it, it was very rough and he did alot to make it readable. despite what you think, your writing has a long way to go before its worthy of being printed professionally. we did what we had to do to make the story printable. you should be thankful, not complaining. ah, the ungrateful writer, gotta love it the contract also says any disagreements you have about the contract must be filed legally in Massachusetts and when you lose, you must pay all court costs. so, we are done here. any more correspondences from you must be from your lawyer. i will then send any of those letters to my lawyer and they can hash it out as i dont waste my time arguing with writers over legalities. thats what lawyers are for. you are so funny. thanks for this email, it truly made my day.

I don't know where to begin, this reply lacks any sort of professionalism, any sort of respect for the writer. But that isn't the worst of it. This is from the folks over at Writer Beware:
Ms. DeGeit's bad experience with Mr. Giangregorio, unfortunately, doesn't seem to be an isolated incident. Similar complaints are appearing in her comments thread, and other writers have reported the same kinds of problems with Undead Press and other publishing ventures run by Giangregorio--who, among other exploits, has apparently published and sold several unauthorized sequels to George Romero's Dawn of the Dead.

PG, from The Passive Voice Blog, is a contract lawyer who specializes in contracts between writers and publishers. Here's what he has to say:
PG will add one more piece of general advice concerning all types of agreements: Don’t do deals with crooks or jerks.

Even with the best contract in the world, if the people on the other side of the agreement are crooks or jerks, you’re going to have a difficult time. On more than one occasion, PG has told a client something like, “With some work, I can probably get your contract whipped into shape, but this guy is still going to drive you crazy and figure out some way to steal from you.”

PG has read enough contracts so he sometimes picks up hints of jerkiness in the way the contracts are worded or assembled.

He can think of one contract from a romance publisher that included all sorts of short clauses about minor items he doesn’t usually see in publishing contracts. The net impression for PG was that the owner of the publisher was a control freak who was going to tell the author exactly how every little thing would be and expected no back talk. The answer to any question or objection by the author would be, “I’m the publisher and you’re not.”

I think that Kris Rusch's advice about reading a contract line by line is terrific. Keeping in mind, of course, that taking someone to court can be an expensive and time consuming ordeal even if you know the other party clearly broke the contract and you're sure to win.

Agents as Publishers: A Scam


At least, according to Dean Wesly Smith it is, and he should know. He writes:

[This scam] is designed to take a writer's work, control their work, and make more money off that work than the writer does.

What scam is this? How does it work?

Writers lose money, lots of money, by allowing an agent to publishing their manuscript through the agent's publishing company. Here's the math:

If you publish your book on Amazon and charge $5.00 for it you would receive 70% of this which comes to $3.50. That $3.50 is yours to keep and do with whatever you want.

If you publish your book through an agent scam the agent takes that $3.50 and splits it down the middle, half for you and half for him. What the author might not realize, though, is that his expenses come only out of your half! So while, in our example, the agent is receiving $1.75 of the $3.50 every pay period, this money doesn't count against his expenses and you, the author, get zilch until all of the agent's expenses are paid.

This is not a good deal for writers.
